TERMS AND CONDITIONS FULFILLMENT POLICY

ALL SALES ARE FINAL – NO RETURNS – NO CANCELLATIONS

Buyer agrees that handles, knobs, locks, screens, shipping and installation is not included in the door and or gate and or railing pricing, unless purchased separately and listed as a line item on invoice. ORDERS ARE NOT SUBJECT TO CANCELLATION. When ordering buyer agrees to having reviewed all details (including but not limited to door size, jambs size, glass type, door swing, handle placement, finish color) and all information provided on the attached CAD (computer animated drawing) is correct and approved to be produced. The buyer agrees the attached CAD is correct and they accept all responsibility for accuracy in all detail of the CAD. All non in-stock merchandise has an expected minimum lead time of 16 weeks lead time from when payment is made. Buyer assumes all risks associated with transportation of merchandise picked up, or delivered by an independent delivery service. Due to the weight of the purchased merchandise, buyer accepts small nicks and rub marks caused by shipping. Seller makes no warranty beyond any written description itemized on this invoice. Such disclaimer does not affect manufactures warranty, if any. Seller will assist buyer in the exercise of factory warranties. Buyer agrees to notify seller of any damage or defects within 24 hours of receipt of merchandise, or seller will not be liable. Availability of merchandise is estimated according to information on hand at the time order is placed. Seller shall not be responsible for delay in delivery of merchandise occasioned by manufactures’ scheduling, stock on hand, availability of materials, transportation difficulties, customs clearance or any other cause beyond seller’s control. Buyer agrees to file and litigate any claim/dispute only in a court in Davis County, Utah, and only after the parties have first submitted to and engaged in commercial mediation in Davis County, Utah. Parties will split the cost of the mediation. A 2% per month charge (24% APR) will be assessed on all past due amounts (from the invoice date) plus attorney’s fees, collection, late, administration and court costs. Buyer agrees Custom Goods are considered non-fungible and as such are ineligible for Cancellation, Refund, or payment chargeback.
